Murder is the intention or reckless infliction of really serious harm to another that causes death. In Victoria, there are two types of common law murder (intentional or reckless murder) and one type of statutory murder known as constructive murder under s 3A Crimes Act 1958.

Manslaughter in Victoria consists of either a death caused by an unlawful or dangerous act or a death caused by criminal negligence. 

Murder and Manslaughter are amongst the most serious criminal charges in Victoria. The maximum penalty for Murder is life imprisonment. The maximum penalty for Manslaughter is 25 years.

In addition, Murder is a ‘standard sentence offence’ under the Sentencing Act 1991, with a standard sentence of 25 years imprisonment.  

Manslaughter is a Category 2 offence under the Sentencing Act 1991. There are also mandatory minimum imprisonment terms for ‘one punch’ manslaughter cases.
